Terms of Use
These Terms govern access to and use of Tiklib. By using the Service, you agree to these Terms and to use Tiklib only in a lawful, respectful, and limited way.
Tiklib is intended for personal archiving, research, discussion, and limited sharing of material to which you own the copyright or otherwise have a right to use and distribute. It is not offered as a public publishing platform or a tool for unauthorised redistribution.
1. Acceptance of Terms
These Terms of Use ("Terms") govern your access to and use of the Tiklib website, browser extensions, applications, and related services (together, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not access or use the Service.
2. Description of the Service
Erizkzang EOOD (a company duly registered in Bulgaria), trading as Tiklib, (hereafter "Tiklib") provides a technical tool that enables users to capture, store, and generate a reading version of web content visible in the user’s own browser at the time of capture.
The Service is user-directed and automated. Tiklib does not ordinarily select, curate, edit, endorse, or pre-screen content captured, stored, or shared by users.
Tiklib acts solely as a provider of technical infrastructure for user-submitted material.
3. Eligibility and Account Security
You may use the Service only if you are legally able to enter into a binding agreement and your use is not prohibited under applicable law.
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account.
You must notify Tiklib promptly of any unauthorised use of your account or any other breach of security.
4. User Responsibility
You are solely responsible for:
- the content you capture, upload, store, generate, or share using the Service
- ensuring that your use of the Service complies with applicable law
- ensuring that you have the legal right to submit, capture, reproduce, and share the material you use through Tiklib
- all consequences of sharing links or content generated through the Service
You agree not to use the Service to:
- infringe copyright, database rights, trade marks, privacy rights, or any other rights of any person
- reproduce or distribute content that you do not have permission to reproduce or distribute
- circumvent paywalls, subscription controls, access restrictions, or other technical protection measures
- violate the terms of service of a third-party website in a manner that is unlawful
- use Tiklib for unlawful, fraudulent, abusive, or misleading purposes
5. Intellectual Property
As between Tiklib and users, Tiklib and its licensors own all rights in the Service itself, including its software, design, branding, and underlying technology, excluding third-party content.
All third-party content captured, stored, or referenced through the Service remains the property of its respective owners. Tiklib does not claim ownership of such third-party material.
Nothing in these Terms transfers any intellectual property rights from Tiklib or any third party to you, except for the limited right to use the Service in accordance with these Terms.
6. User-Generated Content
The Service stores or processes material at the direction of users. Users, and not Tiklib, are responsible for the lawfulness of the content they submit or share.
Tiklib:
- does not actively monitor all user-submitted content
- does not generally review content before it is stored or made accessible
- does not assume editorial responsibility for user-generated material
You acknowledge that Tiklib acts as a neutral technical intermediary in relation to content submitted by users.
7. Limited Sharing and Intended Use
The Service is intended for personal archiving, research, internal discussion, and limited sharing. Tiklib is not offered as a public content publishing or mass redistribution platform.
Tiklib may apply technical restrictions including rate limits, maximum view counts, link expiry, access throttling, bot protections, or similar safeguards intended to discourage abuse and public redistribution.
Tiklib may modify these controls at any time in its sole discretion.
8. Prohibited Uses
You may not use the Service to:
- systematically copy, mirror, or archive websites without lawful authority
- operate the Service as a substitute for licensed access to third-party publications
- upload, transmit, or store malware, malicious code, or harmful content
- scrape, crawl, probe, or reverse engineer the Service except as permitted by law and only to the extent such restriction is unenforceable
- interfere with, disrupt, or overload the Service or related infrastructure
- misrepresent the origin, authorship, or source of content
- use automated systems to create excessive captures, shares, or requests
Tiklib may investigate suspected misuse and may suspend access, remove content, or take any other action reasonably necessary to protect the Service, rights holders, users, or third parties.
9. Notice and Takedown Procedure
Tiklib respects the rights of copyright owners and other rights holders. If you believe content hosted through the Service infringes your rights, you may submit a notice through Tiklib’s takedown process.
A notice should include, at minimum:
- identification of the work or right allegedly infringed
- the URL or other information sufficient to locate the material complained of
- your contact details
- a statement explaining the basis of your complaint and your good-faith belief that the use is unauthorised
- where applicable, a statement that the information provided is accurate
Upon receipt of a sufficiently clear and legally valid notice, Tiklib may remove or disable access to the material, request further information, notify the user involved, or take any other action Tiklib reasonably considers appropriate.
10. Repeat Infringer Policy
Tiklib may suspend or terminate accounts, disable sharing features, remove stored content, or restrict use of the Service for users who repeatedly infringe the rights of others or repeatedly violate these Terms.
Tiklib reserves the right to determine, in its sole discretion, what constitutes repeated infringement or abuse.
11. No Duty to Monitor
Tiklib has no general obligation to monitor the Service, review all user activity, or pre-screen user-generated content.
However, Tiklib reserves the right to investigate, review, remove, disable access to, or restrict content or accounts where it reasonably believes this is necessary to enforce these Terms, comply with law, protect rights holders, or protect the security and integrity of the Service.
12. Availability and Changes to the Service
Tiklib may change, suspend, or discontinue any aspect of the Service at any time, with or without notice.
Features may be added, modified, limited, or withdrawn. Tiklib does not guarantee continued availability of any particular feature, URL, capture, stored content, or sharing function.
13. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Tiklib disclaims all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, or uninterrupted operation.
Tiklib does not warrant that content stored or accessed through the Service is lawful, accurate, complete, current, error-free, secure, or available at all times.
14. Limitation of Liability
To the fullest extent permitted by law, Tiklib and its officers, directors, employees, affiliates, contractors, licensors, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenues, business, goodwill, data, or opportunities, arising out of or relating to the Service or these Terms.
To the fullest extent permitted by law, Tiklib shall not be liable for user-generated content, third-party content, or any infringement, misuse, or unlawful act committed by users or third parties.
To the fullest extent permitted by law, Tiklib’s aggregate liability arising out of or in connection with the Service shall not exceed the greater of: (a) the amount you paid to Tiklib in the twelve months preceding the event giving rise to the claim; or (b) EUR 100.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
15. Indemnity
You agree to indemnify, defend, and hold harmless Tiklib and its officers, directors, employees, affiliates, contractors, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising out of or related to:
- your use of the Service
- your content, captures, uploads, or shares
- your breach of these Terms
- your violation of any law or the rights of any person
16. Suspension and Termination
Tiklib may suspend, restrict, or terminate your access to the Service at any time, with or without notice, if Tiklib believes you have violated these Terms, created risk for Tiklib or others, or where suspension or removal is reasonably necessary for legal, technical, or security reasons.
Tiklib may also remove or disable access to content where reasonably necessary to comply with legal obligations, enforce these Terms, or respond to complaints or technical concerns.
17. Changes to these Terms
Tiklib may revise these Terms from time to time. Updated Terms will be posted on this page, and the updated version will take effect when published unless otherwise stated.
Your continued use of the Service after updated Terms take effect constitutes acceptance of the revised Terms.
18. Governing Law and Jurisdiction
These Terms and any non-contractual obligations arising out of or in connection with them shall be governed by the laws of the jurisdiction in which the Tiklib operating entity is established, without regard to conflict of law rules.
Subject to any mandatory consumer protection laws that apply, the courts of that jurisdiction shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service.
